1.Agreement to these terms
These Terms of Use ("Terms") are a legal agreement between you and Vanderbeck Agency ("Vanderbeck Agency," "we," "us" or "our"). They apply to your use of vanderbeckagency.com and its pages (the "Site"), including our quote forms and website assistant, and to calls, text messages and emails you receive from us after you submit your information.
By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
Section 14 contains an arbitration agreement and class action waiver. Unless you opt out within 30 days, disputes between you and us will be resolved by individual binding arbitration, not in court or by a jury, and you give up the right to take part in a class action.
2.Who we are
Vanderbeck Agency is a local insurance agency that sells Allstate insurance products. We are licensed to sell insurance in New York and Pennsylvania. We operate the Site. Allstate does not operate the Site and is not responsible for its content.
Insurance products we offer are underwritten by Allstate Insurance Company and its affiliated companies, or by another insurer where Allstate has arranged for that coverage. Your policy documents name the company that issues your policy. Not all products, coverages and discounts are available in every state or to every applicant.
How we're paid
As an insurance agent, our role is to sell and service insurance on behalf of the insurer. We are paid by Allstate for the policies we sell and service, usually as a commission that is part of your premium. Compensation may vary depending on the product, the insurer and other factors, such as volume and performance. You can ask us for more information about how we are paid by calling (516) 762-4195.
3.Quotes, coverage and binding
- A quote is an estimate, not a policy. Quotes are based on the information you provide and are subject to verification, underwriting, consumer reports and final approval by the insurer. The final premium may differ from a quote.
- Nothing on the Site binds coverage. Submitting a form, receiving a quote or chatting with our assistant does not put insurance in force. Coverage starts only when it is confirmed to you in writing by our agency or the insurer and, where required, your first payment is made.
- Don't cancel your current policy early. Keep your existing coverage in place until your new coverage is confirmed.
- Your policy controls. Coverage is determined only by the terms, conditions, limits and exclusions of the policy the insurer issues. If anything on the Site differs from your policy, your policy controls.
4.Website content is general information
Our articles, guides, examples, cost ranges and website assistant answers are general information to help you understand insurance. They are not legal, tax or financial advice, and they are not a promise that any loss is covered. Laws, rates and products change, and content may not reflect the latest changes. For advice about your situation, talk with one of our licensed agents, and consult a lawyer or tax professional where appropriate.
Our website assistant answers from a fixed set of answers written by our agency. It can't see your policy, can't bind or change coverage, and can't take claims. For those, call us at (516) 762-4195.
5.Your information must be accurate
You agree to give true, accurate and complete information and to submit forms only for yourself or for people who have authorized you to do so. You agree to provide a phone number and email address that belong to you. If your number changes or is reassigned, please tell us.
Insurers rely on the information in quotes and applications. Knowingly giving false or misleading information to obtain insurance may void coverage and may be a crime under New York and Pennsylvania law.
6.Calls, texts and email
When you submit a form with your phone number and agree to the consent shown with it, you give Vanderbeck Agency your express written consent, by electronic signature, to contact you at that number about your request and about insurance products and services, including by calls and text messages that may use automated technology or prerecorded or artificial voice messages, even if your number is on the National or New York Do Not Call Registry. You also agree that we may email you at the address you provide.
- Consent is not a condition of buying any goods or services. You can reach us by phone at (516) 762-4195 instead.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to any text to opt out of texts. Reply HELP for help.
- You can revoke consent for calls or texts at any time by any reasonable means, including telling us on a call, replying STOP, or calling (516) 762-4195.
- Wireless carriers are not liable for delayed or undelivered messages.
- Calls may be recorded or monitored for quality, training and record-keeping, as described in our Privacy Policy.
Only Vanderbeck Agency will contact you based on your request. We do not sell or share your contact information with other agencies or lead buyers.
7.Consent to electronic records and signatures (E-SIGN)
By using the Site and clicking to submit a form, you agree to do business with us electronically, under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and New York's Electronic Signatures and Records Act.
- Electronic signature. Clicking a submit button such as "Finish & Get My Quote" or "Get My Quote," or typing your name where asked, is your electronic signature and has the same effect as signing on paper.
- Electronic records. You agree that we may give you consents, disclosures, notices and other records electronically, by posting them on the Site, by email or by text message.
- What you need. A device with internet access, a current web browser, a working email address, and the ability to view, save or print web pages and PDF files.
- Paper copies. You may ask for a paper copy of any record we provided electronically at no charge by calling (516) 762-4195 or writing to us.
- Withdrawing consent. You may withdraw your consent to electronic records at any time by contacting us. Withdrawing doesn't affect records already provided, and we may need to handle your request by phone or mail instead.
- Keeping us updated. Please tell us if your email address or phone number changes.
Policy documents and insurer disclosures are delivered by the insurer under the insurer's own electronic delivery terms.
8.Acceptable use
You must be at least 18 years old to submit a quote request. You agree not to:
- use the Site for any unlawful purpose or to submit someone else's information without permission;
- submit false, fraudulent or automated form entries;
- copy, scrape, crawl or harvest content or data from the Site by automated means, except for search engines indexing public pages;
- interfere with, probe or try to gain unauthorized access to the Site, its systems or other users' information;
- upload or send viruses or other harmful code; or
- use the Site or its content to build a competing product or to train artificial intelligence models without our written permission.
We may block access to the Site, reject submissions, or stop communicating with anyone who violates these Terms.
9.Intellectual property and trademarks
The Site's content, including text, articles, graphics, logos, photos and design, belongs to Vanderbeck Agency or is used with permission, and is protected by copyright and trademark laws. You may view and print pages for your personal, noncommercial use. You may not copy, republish or distribute Site content for any other purpose without our written permission.
Allstate, the Allstate logo and related marks are trademarks of Allstate Insurance Company and are used with permission. Other trademarks on the Site belong to their owners.
10.Third-party websites and services
The Site links to websites and services we don't control, including Allstate's customer account site, social media pages and government resources. We provide these links for convenience. We aren't responsible for their content, availability or privacy practices, and your use of them is governed by their own terms.
11.Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL CODE.
12.Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, VANDERBECK AGENCY AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT BE MORE THAN ONE HUNDRED DOLLARS ($100).
This section applies only to your use of the Site and its content. Nothing in these Terms limits any duty we owe you as a licensed insurance agent under New York or Pennsylvania law, the insurer's obligations under your policy, or any liability that cannot be limited by law.
13.Indemnification
You agree to defend, indemnify and hold harmless Vanderbeck Agency and its owners, employees and agents from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or information you submit that you had no right to submit.
14.Dispute resolution and arbitration agreement
This section requires individual binding arbitration of most disputes and waives jury trials and class actions. You can opt out within 30 days, as explained below.
a. Let's talk first
Most concerns can be resolved with a phone call to (516) 762-4195. Before starting arbitration or a court case, the party with the dispute must send a written notice describing it and the relief requested, by mail to the other party (to us at the address in Section 18). Both of us agree to try in good faith to resolve the dispute within 60 days after the notice is received.
b. What this agreement covers
Except as stated below, you and Vanderbeck Agency agree to resolve any dispute, claim or controversy arising out of or relating to the Site, these Terms, our Privacy Policy, or calls, texts or emails between us ("Dispute") by binding arbitration on an individual basis. This includes Disputes about whether this arbitration agreement is valid or applies, which the arbitrator will decide.
c. What it doesn't cover
- Either of us may bring an individual claim in small claims court if it qualifies.
- Either of us may ask a court for an injunction to stop infringement or misuse of intellectual property.
- Disputes about the terms of an insurance policy, a claim under a policy, or coverage are governed by that policy and applicable insurance law, not by this section.
- Nothing here stops you from bringing a concern to a government agency, such as the New York State Department of Financial Services or the Pennsylvania Insurance Department.
d. How arbitration works
Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect when the arbitration starts, available at adr.org, before a single arbitrator. Fees are governed by the AAA's rules and consumer fee schedule, which limit the fees a consumer pays. If you prefer, the arbitration may be held by phone, video or written submissions. Any in-person hearing will take place in the county where you live or in Suffolk County, New York, whichever you choose. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this arbitration agreement.
e. Class action and jury trial waiver
YOU AND VANDERBECK AGENCY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine more than one person's claims and may award relief only in favor of the individual party seeking it. YOU AND VANDERBECK AGENCY EACH WAIVE THE RIGHT TO A JURY TRIAL for any Dispute. If a court decides this class action waiver can't be enforced as to a particular claim, that claim (and only that claim) will be decided in court, and the rest of this arbitration agreement still applies.
f. Your right to opt out
You may opt out of this arbitration agreement by mailing a signed letter to Vanderbeck Agency, Attn: Arbitration Opt-Out, 700 Union Pkwy, STE 5, Ronkonkoma, NY 11779, postmarked within 30 days after you first use the Site or submit a form. Include your name, mailing address, phone number and a statement that you opt out of the arbitration agreement. Opting out won't affect any other part of these Terms or how we treat you.
g. Changes to this section
If we change this arbitration agreement, the change won't apply to a Dispute you had already notified us about, and you may reject the change by writing to us at the opt-out address within 30 days after it is posted.
15.Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules, except that the Federal Arbitration Act governs Section 14. For any Dispute that is not arbitrated, you and we agree to the exclusive jurisdiction of the state courts located in Suffolk County, New York, and the United States District Court for the Eastern District of New York.
16.Changes and termination
We may update these Terms from time to time. We'll post the new version on this page and change the effective date at the top. Changes apply from the date they are posted, except as stated in Section 14(g). If you keep using the Site after a change, you accept the updated Terms. We may change, suspend or discontinue any part of the Site at any time. This version is effective September 27, 2026.
17.General terms
These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any part of these Terms is found unenforceable, that part will be enforced to the extent possible and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them to a successor agency. Headings are for convenience only. The sections on intellectual property, disclaimers, limitation of liability, indemnification, arbitration and governing law survive after you stop using the Site.
